Notary in a Nutshell

Notaries are “ministerial” officials who hold a public office.  Notaries are required to follow instructions exercise common sense, judgment and discretion and understand and adhere to the Notary Laws of the State in which they are commissioned.

Notaries are needed to deter document fraud and to provide assurances about the integrity and proper execution of document transactions via verification of the identity, comprehension and intent of individuals signing documents.

A false statement made to a Notary, under Oath, is Perjury; exactly the same as a false statement made under Oath in a Court of Law. Notarization is serious legal business.

Some of the usual and customary notarial functions include:

  • Witness Affidavits or Depositions upon oath or affirmation.

  • Take Acknowledgements.

  • Witness or attest the signing of deeds and other written instruments pertaining to real property.

  • Administer Oaths or Affirmations that are not required to be administered by a particular officer of the state.

  • Certify copies of  certain documents.

What a Notary is NOT and Does Not Do

  • A notary is not responsible for verifying truth or accuracy of the contents of a document.

  • A notary does not make documents Legal, Official or Validated.

  • A document with errors or discrepancies prior to notarization will contain the same errors if notarized.

*State of Georgia Notaries are prohibited from assignments involving the transfer of real estate without being under the direction and guidance of an attorney and cannot serve in the capacity of a loan signing agent. Please inquire with Notary Public for details.
